1. Overview

This website is operated by Alquatica LLC (“Alquatica,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Alquatica.com, our online store, and any Alquatica-operated sales channel that links to these Terms (collectively, the “Services”).

Our store is hosted by Shopify, which provides the e-commerce platform through which we offer products and services.

By visiting the Site, creating an account, submitting content, or purchasing a product or service, you agree to these Terms and to the policies incorporated into them, including our:

If you purchase through a third-party marketplace or social-commerce platform, that platform’s terms may also apply.

If you do not agree to these Terms, please do not use the Services.

2. Eligibility

You must be at least the age of legal majority in your place of residence to make a purchase through the Services. If you permit a minor in your care to access the Site, you are responsible for supervising that use.

You may not use the Services or our products for an unlawful, fraudulent, or unauthorized purpose.

3. Products and Product Information

Alquatica offers a changing collection that may include original artwork, collaborations, apparel, accessories, home goods, handcrafted pieces, made-to-order products, print-on-demand goods, digital products, and products fulfilled by third-party partners.

We make reasonable efforts to present product descriptions, dimensions, materials, colors, images, prices, and availability accurately. However:

  • Colors may appear differently depending on your screen and device settings.

  • Handcrafted and made-to-order products may contain minor variations.

  • Product packaging or components may change when an equivalent substitution is reasonably necessary.

  • Measurements may vary within the tolerances stated on the product page.

  • Products produced by different fulfillment partners may vary slightly in color, placement, finish, or packaging.

These reasonable variations are not necessarily defects. Nothing in this section limits your rights if an item is materially different from its description, damaged, defective, or otherwise nonconforming under applicable law.

4. Orders and Acceptance

Submitting an order is an offer to purchase the products in your cart. An automated order-confirmation email acknowledges that we received your order but does not necessarily mean that the order has been accepted.

We may accept an order by beginning production, dispatching the product, or providing access to a digital product.

We may lawfully decline, limit, or cancel an order because of:

  • Product unavailability

  • Pricing or listing errors

  • Suspected fraud or unauthorized payment

  • Suspected resale or commercial purchasing

  • Shipping or geographic restrictions

  • Violation of these Terms

  • Circumstances that make fulfillment impracticable

If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method.

If a material pricing error is discovered before fulfillment, we may contact you to approve the corrected price or cancel the affected item for a full refund. We will not charge a higher corrected price without your authorization.

5. Account and Purchase Information

You agree to provide accurate and complete account, billing, payment, and shipping information. You are responsible for promptly updating that information when necessary.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.

6. Prices, Payments, and Taxes

Prices may change without notice, but a price change will not affect an order already accepted except when correcting an obvious error with your approval.

Shipping charges, taxes, customs charges, and other applicable costs will be displayed or described during checkout when reasonably possible.

You authorize Alquatica and its payment processors to charge the payment method submitted for your order. Payment information is processed by Shopify and the applicable payment provider rather than stored directly by Alquatica in complete card-number form.

Discounts, promotional codes, and offers:

  • May be subject to additional stated conditions

  • Cannot be combined unless expressly permitted

  • Have no cash value

  • May be limited, suspended, or withdrawn where legally permitted

  • Cannot be applied retroactively unless expressly stated

7. Production, Fulfillment, and Shipping

Products may be produced, stored, or shipped by Alquatica or by third-party production and fulfillment partners. Items within one order may arrive separately from different locations.

Processing and delivery estimates vary by product and destination. Additional information is provided in our Shipping Policy and on applicable product pages.

If we cannot ship within the timeframe promised when you placed your order, we will provide any notice, cancellation option, or refund required by applicable law.

Our use of a production or fulfillment partner does not require you to resolve an Alquatica order problem directly with that partner. Questions about purchases made from Alquatica should be sent to shop@alquatica.com.

8. Made-to-Order and Custom Products

Some products are created, printed, personalized, or otherwise produced after an order is placed. Production may begin shortly after checkout, so cancellation or alteration may not be possible once fulfillment has started.

Eligibility for cancellation, return, or exchange is governed by the product description, our Return and Refund Policy, and any mandatory rights provided by applicable law.

Customers are responsible for reviewing and approving names, text, measurements, selections, reference materials, or other personalization information before submitting an order.

9. Returns and Refunds

Returns, exchanges, damaged-item claims, and refunds are governed by our Return and Refund Policy.

Nothing in these Terms limits any non-waivable right or remedy available to you under applicable consumer-protection law.

10. Digital Products and Downloads

Unless a product page states otherwise, purchasing a digital product grants you a limited, revocable, nonexclusive, nontransferable license to access and use it for your personal, noncommercial use.

Purchasing a digital product does not transfer its copyright or intellectual-property ownership to you.

You may not, unless expressly permitted by a separate written license:

  • Share or distribute the digital files

  • Resell, sublicense, or commercially exploit them

  • Upload them to file-sharing platforms

  • Reproduce them for sale

  • Remove copyright, attribution, or rights-management notices

  • Use them to create a competing product

  • Use them to train, test, or develop an artificial-intelligence or machine-learning system

Different or additional license terms stated on a product page will control for that product.

Where required by law, we will request your express consent before supplying digital content immediately and ask you to acknowledge when beginning the download may affect a statutory withdrawal right.

11. Gift Cards

Alquatica gift cards are governed by the gift-card provisions in our Return and Refund Policy and any terms displayed when the gift card is purchased.

Gift cards may not be used for unauthorized resale, fraud, or unlawful activity.

12. Alquatica Intellectual Property

The Site and its contents—including Alquatica’s photographs, videos, artwork, illustrations, characters, designs, graphics, logos, text, recipes, written materials, product concepts, digital products, audio, styling, and other creative material—are owned by Alquatica or used with permission from the applicable artist, collaborator, or licensor.

Except for the limited personal use expressly allowed by these Terms, you may not copy, reproduce, modify, publish, distribute, display, sell, license, create derivative works from, or commercially exploit this material without written permission from the applicable rights holder.

You may not scrape, harvest, or systematically extract Site content, or use it as training, testing, reference, or input data for generative artificial intelligence or machine-learning systems, without Alquatica’s prior written permission.

Purchasing a physical artwork, print, garment, or other product transfers ownership of that particular physical item only. It does not transfer copyright, trademark rights, character rights, reproduction rights, commercial-use rights, or ownership of the underlying creative work.

13. Third-Party Intellectual Property and References

Names, titles, trademarks, characters, games, stories, symbols, and other creative properties belonging to third parties remain the property of their respective owners.

Unless expressly stated, references to third-party properties do not imply that Alquatica is affiliated with, sponsored by, or endorsed by their owners.

14. Collaborations

Certain products or creative works may be developed with guest artists, photographers, designers, musicians, or other collaborators. Rights in collaborative material are owned or licensed according to the applicable agreement between Alquatica and the collaborator.

Customers do not acquire rights to reproduce or commercially exploit collaborative material by purchasing a product containing that material.

15. Reviews, Photographs, and User Content

If you submit or post a review, photograph, video, testimonial, comment, or other content in connection with Alquatica (“User Content”), you retain any ownership rights you have in that content.

You grant Alquatica a nonexclusive, worldwide, royalty-free license to reproduce, display, distribute, reformat, crop, and share that User Content for operating, promoting, and marketing Alquatica and its products. This license includes permission to display the name, username, or social-media handle you submitted with the content.

You represent that:

  • You created the User Content or have permission to submit it.

  • The User Content does not violate another person’s intellectual-property, privacy, publicity, or other rights.

  • The User Content is accurate and does not contain unlawful, defamatory, deceptive, threatening, or malicious material.

  • Any opinions stated reflect your honest experience.

We may remove User Content that violates these Terms, but we are not obligated to monitor every submission.

Please do not send confidential business proposals, unreleased creative concepts, or proprietary ideas unless we have agreed in writing to receive them confidentially. Submitting unsolicited ideas does not create a confidential, fiduciary, employment, partnership, or compensation relationship.

16. Acceptable Use

You may not use the Services to:

  • Violate any applicable law or another party’s rights

  • Commit fraud or submit false or misleading information

  • Infringe intellectual-property, privacy, or publicity rights

  • Harass, threaten, abuse, impersonate, or discriminate against others

  • Introduce malware, viruses, or harmful code

  • Interfere with the security or operation of the Services

  • Collect personal information about others without authorization

  • Spam, phish, scrape, crawl, or access the Services through unauthorized automated means

  • Circumvent purchase limits, security measures, or access restrictions

  • Use Site content for unauthorized commercial purposes

  • Assist another person in doing any of the above

We may restrict or terminate access when we reasonably believe these Terms have been violated.

17. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, social platforms, payment services, marketplace services, or tools.

We do not control independent third-party websites and are not responsible for their content, security, availability, or privacy practices. Your use of those websites is governed by their own terms and policies.

This limitation does not remove Alquatica’s responsibilities for products purchased directly from Alquatica merely because we use a third party to process payment, manufacture, or fulfill the order.

18. Affiliate Links

Some Site content may include affiliate or referral links. If you make a purchase through one of these links, Alquatica may earn a commission or receive another benefit at no additional cost to you.

Where required, we will provide a clear disclosure near the applicable recommendation or link. Inclusion of an affiliate link does not guarantee that a third-party product or service will meet every customer’s needs.

19. Educational and Informational Content

Creative, cultural, historical, culinary, wellness, botanical, or other informational content published by Alquatica is provided for general educational and entertainment purposes.

It is not a substitute for professional medical, nutritional, legal, financial, safety, or other individualized advice. You are responsible for evaluating whether an activity, recipe, ingredient, tool, or recommendation is appropriate for your circumstances, including any allergies, medical conditions, local laws, or safety considerations.

20. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that information may be processed by Shopify and other providers needed to operate the store, process payments, prevent fraud, communicate with you, and fulfill purchases, subject to the Privacy Policy and applicable law.

21. Availability, Errors, and Changes

We may update, suspend, discontinue, or change products, features, prices, or Site content where legally permitted.

We may correct typographical errors, inaccurate descriptions, or availability information. If a correction materially affects an order you already placed, we will notify you and provide any approval, cancellation, or refund option required by law.

Historical, editorial, or archival material may be presented for reference and should be understood in its original context.

22. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its general informational content are provided on an “as available” basis. We do not guarantee that the Site will always be uninterrupted, secure, or error-free.

This section does not disclaim:

  • Any express product promise made by Alquatica

  • Liability for supplying a materially misdescribed, damaged, defective, or nonconforming product

  • A warranty or legal guarantee that cannot lawfully be excluded

  • Any other non-waivable consumer right

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Alquatica and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Services.

To the fullest extent permitted by law, Alquatica’s aggregate liability arising from a particular order will not exceed the amount you paid to Alquatica for that order.

These limitations do not apply where prohibited by law and do not exclude or limit liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of non-waivable consumer rights.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold Alquatica harmless from third-party claims, damages, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Services

  • User Content you submit

  • Your material breach of these Terms

  • Your violation of another party’s rights

This section does not require a consumer to indemnify Alquatica for Alquatica’s own unlawful conduct, negligence, or breach of these Terms.

25. Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate your account or access if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created a security or legal risk.

Termination does not affect rights or obligations that arose before termination. Provisions concerning payment, licenses, intellectual property, liability, and dispute resolution will survive where their nature requires.

26. Changes to These Terms

We may update these Terms to reflect changes in our Services, business practices, or legal obligations.

The “Last updated” date identifies the latest revision. Material changes will apply prospectively, and we will provide additional notice or obtain consent when required by law.

Your continued use of the Services after revised Terms take effect constitutes acceptance to the extent permitted by applicable law.

27. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

To the extent permitted by law, disputes arising from these Terms or the Services will be brought in an appropriate state or federal court located in Missouri.

If you are a consumer residing in a jurisdiction that gives you mandatory rights to bring a claim elsewhere or applies mandatory local consumer law, this section does not take those rights away.

Before beginning formal proceedings, we encourage you to contact us at shop@alquatica.com so we can attempt to resolve the concern.

28. Severability, No Waiver, and Entire Agreement

If a provision of these Terms is found unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

These Terms and the policies incorporated by reference form the entire agreement governing your use of the Services and your purchases, except where a separate written agreement or product-specific license expressly applies.
